Terms of Service

Welcome to Entertainment Industry Social (“the Site,” “we,” “us,” or “our”), operated by Illuminet, LLC, PO Box 763, Waite Park, MN 56387. These Terms of Service (“Terms”) govern your access to and use of entertainmentis.com, a private BuddyPress social network for indie musicians, artists, actors, and industry representatives.

By creating an account, accessing, or using the Site, you agree to these Terms. If you do not agree, do not use the Site.

1. Eligibility

You must be at least 18 years old (or the age of majority in your jurisdiction, if higher) to hold an account on or use the Site, and by using the Site you represent that you meet this requirement.

Members must be 18 or older. Entertainment Industry Social is a private, invite-only community for adults. By using this site you confirm that you are at least 18 years old. Accounts belonging to anyone under 18 will be removed. Questions? Contact the Admin.

Paid memberships and any paid features, when offered, are available only to users who are 18 years of age or older (or the age of majority in your jurisdiction, if higher).

By using the Site, you represent that you meet these age requirements and that the information you provide is accurate.

2. Accounts and Memberships

The Site currently offers a free basic membership. We may introduce paid plans, upgrades, or add-ons in the future. Paid-plan pricing, features, billing, and refunds will be described when those plans become available and may be updated from time to time.

You are responsible for keeping your login credentials secure and for all activity under your account. Notify us promptly if you believe your account has been compromised.

We reserve the right to approve, refuse, suspend, or terminate accounts at our discretion, including accounts awaiting approval.

3. Paid Plans and Refunds (Placeholder)

When paid memberships or upgrades are offered:

  • Fees, billing intervals, and included features will be stated at checkout or on the membership page.
  • Unless otherwise stated at the time of purchase, fees are non-refundable except where required by law.
  • You may cancel a paid plan according to the cancellation instructions provided when that plan is available; cancellation typically stops future charges but does not refund past periods already paid.
  • We may change pricing or features with reasonable notice for recurring plans.

4. User Content

You may upload, post, or share content on the Site, including profile information, activity updates, media (audio, video, images), documents, messages, comments, and other materials (“User Content”).

You retain ownership of your User Content. By posting or uploading User Content, you grant Illuminet, LLC a worldwide, non-exclusive, royalty-free, transferable license to host, store, display, reproduce, distribute, and otherwise use that User Content solely to operate, promote, and improve the Site and related Illuminet services. This license ends when you delete the content or your account, except for copies that may remain in backups for a reasonable period and content that others have shared or reshared.

You represent that you have all rights needed to post your User Content and that it does not infringe others’ rights or violate these Terms or applicable law.

5. Prohibited Conduct

You agree not to:

  • Harass, threaten, defame, or abuse other members
  • Post illegal, fraudulent, or sexually exploitative content, including content involving minors
  • Infringe copyrights, trademarks, or other intellectual property rights
  • Spam, scrape, or use automated means to access the Site without permission
  • Impersonate another person or misrepresent your affiliation
  • Upload malware, attempt to hack the Site, or interfere with its security or operation
  • Share others’ private messages or personal data without consent
  • Use the Site for unauthorized commercial solicitation outside of approved advertising or membership features
  • Violate any applicable law or these Terms

We may remove content and restrict or terminate accounts that violate these rules.

6. Advertising

The Site may display sidebar and other advertisements, including ads placed by Illuminet, LLC or third parties. Advertisers must follow our Advertising Policy. We are not responsible for third-party ad content or websites linked from ads.

7. Termination

You may stop using the Site and request account deletion at any time through your account settings or via our Contact page.

We may suspend or terminate your access immediately if you violate these Terms, if required by law, or for operational or security reasons. Upon termination, your right to use the Site ends. Provisions that by their nature should survive (including licenses for content already shared, liability limits, and governing law) will survive.

8. Disclaimers

THE SITE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not guarantee uninterrupted or error-free service, or that User Content will always be available or accurate.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ILLUMINET, LLC AND ITS OFFICERS, MEMBERS, AND AGENTS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SITE.

OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF THESE TERMS OR THE SITE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID US FOR PAID MEMBERSHIP IN THE TWELVE (12) MONTHS BEFORE THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS (USD $100) IF YOU HAVE ONLY USED a free membership.

Some jurisdictions do not allow certain limitations; in those cases, our liability is limited to the fullest extent permitted by law.

10. Indemnity

You agree to indemnify and hold harmless Illuminet, LLC from claims, damages, and expenses (including reasonable attorneys’ fees) arising from your User Content, your use of the Site, or your violation of these Terms or others’ rights.

11. Governing Law

These Terms are governed by the laws of the State of Minnesota, without regard to conflict-of-law rules. You agree to the exclusive jurisdiction of the state and federal courts located in Minnesota for disputes arising from these Terms or the Site, except where prohibited by law.

12. Changes

We may update these Terms from time to time. The effective date at the top will change when we do. Continued use of the Site after changes means you accept the updated Terms. Material changes may also be announced on the Site or by email when practical.
